The Alberta court of Queen’s Bench has declared that an Alberta law violates the rights of transgendered individuals.
The law in question says that a transgendered person must undergo gender reassignment surgery before they can legally change the gender on their birth certificate.
Justice Brian Burrows ruled on Thursday that the legislation is in violation of the constitution, and must be changed.
The decision came came after a 23-year old woman filed a legal challenge. The government now has 30 days to issue a new birth certificate to the woman.
Premier Dave Hancock says the wording requiring surgery will be dropped from the law, but did not provide a timeframe as to when that would happen.
