A Court of Queen's Bench is getting involved with an Edmonton police officer's disciplinary hearing.

Mike Wasylshen did not appear at his disciplinary hearing Friday, but his lawyer did.

Wasylshen is charged with five counts of misconduct for allegedly Tasering Randy Fryingpan several times while he was arresting him back in 2002.

His lawyer is trying to have the charges dropped, arguing the length of time the process has taken is a violation of Wasylshen's Charter of Rights.

"We're asking the court to say that the presiding officer does have jurisdiction to make the ruling and say enough is enough. This thing has gone on long enough, it'll be nine years," said Wasylshen's lawyer, Robert Hladun.

Now, that argument will move to a courtroom. A judge will review the application on Nov. 22nd, before the disciplinary hearing can resume.
