WIN A CAR CONTEST

OFFICIAL RULES AND REGULATIONS


1. The WIN A CAR contest (the “Contest”) starts at 05:30 a.m. Mountain Time (“MT”) on October 13, 2015 and closes on November 10, 2015 at 09:30 a.m. MT (the “Contest Period”). The Contest Period includes twenty-one (21) separate entry periods (each, an “Entry Period”), as follows:

2. The Contest sponsor is Bell Media Inc. (hereinafter referred to as the “Contest Sponsor”).


3. NO PURCHASE NECESSARY. To enter, watch CTV Morning Live (from 5:30 a.m. to 9:00 a.m. MT, weekdays) on CTV on the local cable or satellite channel in your area from October 13, 2015 to November 10, 2015 to view a contest word (each, a “Contest Word”). There will be one (1) Contest Word per Entry Period, and each Contest Word will be different. Once you have a Contest Word, there are two (2) ways to enter the Contest, as follows:

a. Text Message: To enter via text message, send a text message that includes the Contest Word during the same Entry Period during which it was announced to short code “103030” (each, a “Text Entry”). Text messaging is not available in all areas. Standard text messaging and short code fees apply (consult with your carrier applicable fees before participating via text message).

OR

b. Email: To enter via email, send an email that includes your phone number, mailing address, full name, email address, the Contest Word and the date that that Contest Word appeared on CTV Morning Live edmontoncontests@ctv.ca (each, an “Email Entry”).

 

Collectively, Text Entries and Email Entries will be referred to as “Entries”. By submitting an Entry, you agree to be legally bound by these Official Rules and Regulations (the “Rules”). Limit of one (1) Entry per person/telephone number per Entry Period/Contest Word. If it is discovered by the Contest Sponsor (using any evidence or other information made available to or otherwise discovered by the Contest Sponsor) that any person has attempted to: (i) exceed any of the limits stated in these Rules; and/or (ii) use multiple names, identities, email addresses, telephone numbers and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Contest Sponsor. Your Entry may be rejected if (in the sole and absolute discretion of the Contest Sponsor) it is not fully completed with all required information and submitted and received in accordance with these Rules during the Contest Period. The Released Parties (defined below) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void). All Entries are subject to verification at any time and for any reason. The Contest Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Contest Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the complete satisfaction of the Contest Sponsor within the timeline specified by the Contest Sponsor may result in disqualification in the sole and absolute discretion of the Contest Sponsor. The sole determinant of the time for the purposes of this Contest will be the Contest server machine(s).

Text Entries shall be deemed to be submitted by the Authorized Mobile Account Holder of the mobile phone used to enter the Contest. “Authorized Mobile Account Holder" of a mobile phone is defined as the natural person who is assigned to a cellular telephone number by a wireless carrier that is responsible for assigning cellular telephone numbers. An eligible Prize winner may be required to provide proof that he/she the Authorized Mobile Account Holder associated with the selected Text Entry. Email Entries shall be deemed to be submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.


4. To enter and to be eligible to win, entrant must be a legal resident of Alberta, residing north of the southern boundary of Red Deer County, and be eighteen (18) years of age or older. Employees and their parents, siblings and children, and persons domiciled with an employee of the Contest Sponsor, its agents, parent, affiliated or related companies, subsidiaries, divisions, prize sponsors, and promotional and advertising agencies and administrators (collectively, the “Contest Parties”) are ineligible to enter.


5. Prizes - There is one (1) prize ( “Prize”) available to be won. The Prize consists of a 2016 Hyundai Elantra (GLS). Approximate retail value of the Prize is $22,399 CAD. The Prize will include destination/freight charges and all applicable fees and taxes. Without limiting the generality of the foregoing, the following general conditions apply to the Prize: (i) the Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted by the Contest Sponsor in its sole and absolute discretion); (ii) no substitutions except at Contest Sponsor’s option; (iii) Contest Sponsor reserves the right at any time to substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater value, including, without limitation, but solely at the Contest Sponsor’s sole discretion, a cash award; (iv) colour and other specifics of the Prize will be at the sole and absolute discretion of the Contest Sponsor and subject to availability; (v) manufacturer’s standard warranty applies to the Prize; (vi) upon notification, the confirmed Prize winner may, in the sole and absolute discretion of the Contest Sponsor, be required to personally take delivery of the Prize from a dealership within the greater Edmonton area as determined by Contest Sponsor, in its sole and absolute discretion, and will be required to present adequate personal identification (in a form acceptable to the Contest Sponsor – including, without limitation, government issued photo identification); (vii) Prize will not be released unless and until the confirmed Prize winner first shows proof (in a form acceptable to the Contest Sponsor) of having a valid driver’s license (equivalent to a full “G” class license in Ontario) in Alberta and proof (in a form acceptable to the Contest Sponsor) of satisfactory insurance; (viii) confirmed Prize winner is solely responsible for all expenses that are not included in the Prize description above, including, but not limited to: registration and license fees, insurance, additional accessories and all other costs associated with: (a) any upgrade or option package(s) that he/she may request (and that may be permitted by Contest Sponsor in its sole and absolute discretion); and/or (b) obtaining a valid driver’s license, license plates, registration, insurance and/or fuel.


6. On November 10, 2015 in Edmonton, Alberta at 9:40 a.m. MT, three (3) eligible entrants will be selected as finalists (each, a “Finalist”) by random draw from among all eligible Entries received during the Contest Period in accordance with these Rules. The odds of being selected as a Finalist will depend on the total number of eligible Entries received during the Contest Period in accordance with these Rules. CTV Edmonton will attempt to notify each Finalist that he/she is a Finalist by telephone on November 10, 2015. In the event a Finalist cannot be contacted directly by phone (voicemail is not acceptable) he/she will be disqualified (and will forfeit his/her chance to win the Prize) and an alternate Finalist may be drawn at the Contest Sponsor’s sole and absolute discretion. Each Finalist must also correctly answer, unaided, a mathematical skill-testing question. Proof of identification must be provided upon request.


7. The event to select the Prize winner will take place on CTV Morning Live at CTV Edmonton (18520 stony plain road, Edmonton, Alberta) on November 13, 2015 between 5:30 a.m. and 9:30 a.m. MT (the “Event”). Each Finalist will be required to personally and physically attend the Event. Each Finalist is solely responsible for all costs associated with attending the Event, including, but not limited to, transportation to and from the Event. Before the beginning of the Event, each Finalist will be required to: i) register at the Event registration desk by 5:00 a.m. MT; ii) provide proof of identification (e.g. in the form of government-issued photo identification); and (iii) sign a release prepared by the Contest Sponsor, which (among other things) permits the Contest Sponsor to film his/her image, name and any other likeness (the “Footage”) and to reproduce, edit, broadcast and otherwise exploit the Footage in any media whatsoever, including without limitation CTV broadcast television. If a Finalist does not comply with any of these requirements, he/she will be disqualified (and will forfeit his/her chance to win the Prize).


8. At the start of the Event, each eligible Finalist (as determined by the Contest Sponsor in its sole and absolute discretion) will choose a box from among a number of boxes that corresponds to the number of eligible Finalists (as determined randomly by the Contest Sponsor in its sole and absolute discretion); only one (1) of the boxes will contain a key to the winning car (the “Key”). Afterwards, at the same time and following the Contest Sponsor’s instructions, each eligible Finalist will open his/her selected box and the eligible Finalist whose selected box contains the Key (as determined by the Contest Sponsor in its sole and absolute discretion) will be the potential Prize winner. The odds of winning the Prize from amongst the eligible Finalists will depend on the number of eligible Finalists that comply with these Rules, but will be no worse than 1 in 3.


9. In order to be confirmed as the Prize winner, the potential Prize winner must sign and return within the time stipulated by the Contest Sponsor, a full release and indemnity form stating that, among other things, he/she has read and understood these Rules, grants all consents required, agrees to be available and to participate in publicity and/or promotions related to the Contest and/or the Contest Sponsor and/or similar matters, authorizes the Contest Sponsor to broadcast, publish, disseminate and otherwise use his/her name, city/town/village and province/territory of residence, photograph, likeness, sobriquet and voice, in connection with any promotion and/or publicity, and/or for general news, entertainment and/or information purposes at no additional compensation to the potential winner, beyond the awarding of or participation in the Prize, accepts the Prize as offered and releases the Contest Parties and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability of any kind arising out of the potential winner’s participation in this Contest and receipt and use of the Prize. In the event that the potential winner does not comply with all the provisions as contemplated in these Rules, Contest Sponsor shall have the right to disqualify the potential winner, and the Contest Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.


10. All decisions of the Contest Sponsor with respect to any aspect of this Contest, including without limitation the eligibility of Entries, entrants and Finalists are final and binding on all entrants in all matters as they relate to this Contest. By participating in this Contest, each entrant solicits all notification and potential winner confirmation messages as outlined in these Rules via electronic means, telecommunications or any other means.


11. All Entries become property of Contest Sponsor who assumes no responsibility for garbled, lost, late, delayed, destroyed or misdirected Entries, mail, voice messages, e-mail, text message or any computer errors or malfunctions. No correspondence will be entered into except with entrants requesting Rules by mail or requesting the name of the Prize winner (for which a self-addressed, postage paid envelope must be included). Contest Sponsor does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials or data that have been tampered with or altered are void. For greater certainty and the avoidance of doubt, it is the intention of the Contest Sponsor that one (1), and only one (1), of the boxes will contain the Key. If for any reason, in the opinion of the Contest Sponsor, in its sole discretion, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond its control, Contest Sponsor reserves its right to cancel, terminate, modify, amend, extend or suspend the Contest, and/or select the potential Prize winner by random draw from among the eligible Finalists. Contest Sponsor reserves its right to modify the Rules without materially affecting the terms and conditions hereof. The Contest Sponsor reserves its right in its sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Rules or otherwise in a disruptive manner. Any attempts to deliberately damage the Contest web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made the Contest Sponsor reserves its right to seek remedies and damages to the fullest extent of the law. Contest Sponsor shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to an entrant’s computer equipment, system, software or any combination thereof, as a result of their participation in this Contest or from downloading any material from the Contest web site. Without limiting the generality of the forgoing, the Contest Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.

 

12. Contest is subject to all applicable federal, provincial and municipal laws and regulations. By entering this Contest, each entrant consents to the collection, use and distribution of his or her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Contest Sponsor for the purposes of implementing, administering and fulfilling this Contest. Contest Sponsor will not sell or transmit this information to third parties except for the purposes of administering this Contest. By entering the Contest, each entrant consents to the manner of collection, use and disclosure of personal information as set out in Bell Media Inc.'s Privacy Policy, which is available at bellmedia.ca/about/Media_Privacy.page. Any inquiry concerning the personal information held by the Contest Sponsor should be addressed to Bell Media Inc. at 18520 – Stony Plain Road Edmonton, AB T5S 2E2.

 


13. In the event of any discrepancy or inconsistency between the terms and conditions of the Rules and disclosures or other statements contained in any Contest related materials, including but not limited to point of sale, television, print or online advertising, the terms and conditions of the Rules shall prevail, govern and control.


14.All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by the Contest Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
