The future of Lucy the elephant will not be determined in a courtroom. A judge has thrown out a lawsuit by animal rights activists trying to force the city of Edmonton to move the Asian elephant from the Valley Zoo.

People for the Ethical Treatment of Animals was one of the groups fighting to have Lucy relocated to a warmer climate, saying she is being treated inhumanely at the Valley Zoo. A spokesperson for PETA is expressing disappointment with the judge's decision.

"The judge's ruling today demonstrates what little legal protection exists for animals who are kept in grossly substandard conditions," complained David Perle, senior media coordinator for PETA.

PETA states it intends to pursue other legal action and worries that Lucy will continue to suffer from arthritis, chronic foot ailments and obesity unless a law enforcement agency rules on what's best for the animal.

Animal rights activists have been demanding the elephant be moved to a sanctuary in a warmer climate where she can spend time with other elephants.

Celebrities such as Hollywood actor William Shatner and former Price is Right host Bob Barker have stood behind the animal rights groups in their battle to see the elephant moved to a warmer climate.

The city has announced it will hold a news conference Friday afternoon to discuss the latest developments. In the past, the city has defended Lucy's current living arrangement, saying she is well-cared for and that her care meets or exceeds all regulatory standards.
