A week after a van crashed into a classroom, injuring a number of students and killing one - the man accused in the tragedy was denied bail.

On Thursday, the decision was released by a judge in a St. Paul courtroom, meaning Richard Benson, 46, will remain behind bars.

Benson was arrested after a van crashed into a Grade 6 classroom at Racette Junior High School in St. Paul last Thursday.

Eight students were injured in the crash, three of them suffered serious injuries and were airlifted to hospital in Edmonton – the other five were treated in St. Paul.

On Friday, CTV News learned 11-year-old Megan Wolitski had succumbed to her injuries in hospital.

Benson is facing a charge of criminal negligence causing death, two charges of criminal negligence causing bodily harm, and one charge each of resisting arrest and possession of a controlled substance.

The accused made his first court appearance Monday, but the decision was reserved.

Richard Benson's lawyer said he plans to appeal the decision, however no date has been set to hear the appeal.

His next court date has been scheduled for December 13.
