RCMP are investigating the actions of one of their own, after a violent incident that took place during an arrest was recorded – and then surfaced online.

Police said the incident occurred at about 1 a.m. on Saturday, September 22 after complaints regarding about 100 intoxicated people who had been at a birthday party at a community hall outside of Cold Lake.

It was the third time RCMP officers had visited the hall that night – and police said as officers tried to disperse the crowd – an intoxicated man refused to leave, and police said he started to act aggressively towards officers.

That man, Richard Claybert spoke to CTV News on the incident, and admitted an argument ensued.

Claybert said he turned away from the police – and didn’t hear what they said to him.

The rest was caught on camera – and police had him on the ground.

“Well they could have done it better, because, being hearing impaired, and then not being able to hear the cops when I walked away, and then turn around to be pepper sprayed, was kind of extreme,” Claybert said in a phone interview from Cold Lake.

RCMP said the officer decided to arrest the man, because he felt Claybert, who is 5’10” and 300 lb. was escalating the crowd, who was reportedly encouraging him to fight police.

Then, the incident escalated – and RCMP said Claybert was kicked in the face once, and once in the chest.

“It was extreme, no one should be kicked in the face while handcuffed or pepper sprayed,” Claybert said.

RCMP said officers were in the process of putting the handcuffs on Claybert at the time he was kicked.

The video was uploaded to Youtube by a mother of someone who was present when the incident happened.

Claybert said he suffered injuries to his ribs, and his legs – but did not go to hospital.

The constable in question is on administrative duties until the investigation is complete.

Claybert has been scheduled to appear in court in Cold Lake Provincial Court in late November.

Police said they had not received a public complaint about the use of force in that arrest.
